This Privacy Policy describes how Growth Building Solutions LLC, doing business as The Oru Group ("The Oru Group," "we," "us," or "our"), collects, uses, discloses, and protects information about you when you visit www.theorugroup.com and any related pages, landing pages, and forms that link to this Privacy Policy (collectively, the "Site"), and when you communicate with us or engage us for development, commercial, custom home, design, or strategy services (together with the Site, the "Services").

By using the Site, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use the Site or submit information to us.

Our website contact form collects your name, email address, and telephone number, along with any information you choose to include about your project. Form submissions are transmitted to and stored within our website platform and connected business systems so that our team can respond to you.

The categories of information you may provide include:

Identifiers and contact information — name, email address, telephone number, and, where you provide it, mailing or property address
Project information — the location, type, size, scope, timeline, and design preferences of a proposed or active project; existing property details; and any drawings, photographs, surveys, or documents you send us
Professional and relationship information — your role in the project, and the identity and contact details of your architect, designer, lender, broker, attorney, or other advisers where you share them
Financial context you volunteer — general budget range, financing status, or lender information you choose to share so we can scope a project. We do not collect payment card numbers or bank account numbers through the Site.
Communications content — the substance of your emails, form submissions, messages, and notes from calls and meetings

Information Collected Automatically

When you visit the Site, we and our service providers may automatically collect:

Device and browser information — IP address, browser type and version, operating system, device type, screen resolution, and language settings
Usage information — pages and projects viewed, links clicked, time spent on pages, scroll depth, video engagement, form interactions, referring and exit pages, and the date and time of your visit
Approximate location — a general geographic location (such as city, region, and country) inferred from your IP address. We do not collect precise GPS location from the Site.

Publicly available sources — such as county appraisal district and property records, permitting records, business registries, and public web pages, where relevant to a project or inquiry

Information We Do Not Seek

We do not seek to collect sensitive personal information such as Social Security numbers, driver's license numbers, government identification numbers, precise geolocation, biometric data, or health information through the Site. Please do not submit this type of information through our website forms. Where a specific engagement requires sensitive information, we will collect it through a secure channel and use it only for the purpose disclosed to you.

We use the information we collect to:

Respond to your inquiry — reply to your form submission, answer questions, and schedule consultations, meetings, and site visits
Scope and price work — evaluate project feasibility, prepare proposals, estimates, and design concepts, and assemble the right team for your project
Deliver our Services — plan, design, permit, build, and manage projects, coordinate with your architects, engineers, trade contractors, vendors, and lenders, and communicate with you throughout a project
Administer our business — maintain project records, invoicing and accounting, insurance, warranty and punch-list follow-up, and vendor management
Market our work — send updates about our projects and services where you have asked to hear from us, and promote completed work consistent with Section 6
Advertise — measure the performance of our advertising, build and refine audiences, and show relevant ads on third-party platforms
Improve the Site — analyze usage patterns and develop better content and features
Protect our business — detect and prevent fraud, abuse, and unlawful activity, secure the Site, and enforce our Terms of Use
Comply with law — meet legal, permitting, licensing, tax, insurance, and recordkeeping obligations, respond to lawful requests, and establish or defend legal claims
‍With your consent — for any other purpose disclosed to you at the time of collection

Legal Bases (for individuals in the European Economic Area and United Kingdom)

Where the EU or UK General Data Protection Regulation applies, we process personal data based on: (a) your consent, which you may withdraw at any time; (b) performance of a contract with you or steps taken at your request before entering into a contract; (c) our legitimate interests in operating, securing, marketing, and improving our business, where not overridden by your rights; and (d) compliance with a legal obligation.

How We Share Your Information

We do not sell your personal information for money. We share personal information in the following circumstances:

Project team members. Delivering a construction or design project requires collaboration. We share the information necessary to plan and complete your project with architects, engineers, interior designers, surveyors, trade contractors and subcontractors, material suppliers, permitting expediters, inspectors, and municipal authorities. We share only what is needed for the work being performed.

Service providers. We share information with vendors who perform services on our behalf, including our website host and content management platform, form and email providers, project management and estimating software, customer relationship management systems, cloud storage, accounting and payment processors, analytics providers, our accessibility tool provider, and professional advisers such as attorneys, accountants, and insurers. These providers may use the information only to perform services for us.

Advertising and analytics partners. We share limited information — such as cookie or device identifiers, IP address, and on-site activity — with advertising and analytics platforms so we can measure campaign performance and deliver relevant advertising. Under certain state privacy laws, this type of sharing may be considered a "sale" of personal information or "targeted advertising" or "cross-context behavioral advertising," even though no money changes hands. See Section 9 for how to opt out.

Affiliates and related entities. We may share information with entities under common ownership or control with Growth Building Solutions LLC for the purposes described in this Privacy Policy.

Business transfers. If we are involved in a merger, acquisition, financing, reorganization, sale of assets, or bankruptcy, your information may be transferred as part of that transaction. We will take reasonable steps to ensure the recipient honors this Privacy Policy.

Legal and safety. We may disclose information when we believe in good faith that disclosure is necessary to comply with applicable law, a subpoena, court order, lien or claim process, or other legal process; to enforce our agreements; to investigate potential violations; or to protect the rights, property, or safety of Growth Building Solutions LLC, our clients, our workers, or the public.

With your direction or consent. We share information at your direction or with your consent.

Project Photography, Addresses, and Client Privacy

We photograph, film, and publish completed and in-progress work as part of marketing our business. We understand that our clients' homes are private, and we handle project publicity as follows:

We do not publish a client's name in connection with a residence unless the client has agreed
We generally identify residential projects by neighborhood or general area rather than by street address
Where a written agreement between us addresses photography, publicity, confidentiality, or non-disclosure, that agreement governs
If you would like a project, image, or identifying detail removed from our Site or social media, contact us at austin@theorugroup.com and we will honor the request going forward, though we may be unable to recall materials already distributed or reposted by third parties

If you provide a testimonial or review, you grant us permission to publish it along with your first name, last initial, and general location unless you tell us otherwise in writing.

Cookies and Tracking Technologies

We and our partners use cookies, pixels, web beacons, local storage, and similar technologies to operate the Site and understand how it is used.

Types of technologies we use:

Strictly necessary — required for the Site to function, including session management and security
Performance and analytics — help us understand how visitors find and use the Site so we can improve it
Functional — remember your preferences and settings
Advertising and targeting — used by us and our advertising partners to measure ad performance and deliver relevant ads on other websites and platforms

Specific third-party technologies we use. The Site currently uses the following:

Google Analytics, a web analytics service provided by Google LLC, which uses cookies and similar identifiers to help us understand how visitors find, navigate, and use the Site. Google's handling of this information is governed by the Google Privacy Policy at policies.google.com/privacy, with additional information at policies.google.com/technologies/partner-sites.
Meta Pixel, provided by Meta Platforms, Inc., which allows us to measure the effectiveness of our advertising on Facebook and Instagram, understand what visitors do on the Site after seeing or clicking an ad, and build audiences for future advertising. Meta's handling of this information is governed by the Meta Privacy Policy at www.facebook.com/privacy/policy.
An accessibility tool, which may store a cookie or local storage entry on your device to remember the display and navigation preferences you select, as described in our Accessibility Statement.

We may also use cookies or tags from Google Ads, YouTube, TikTok, Instagram, and similar advertising or content platforms, including where social media content is embedded on the Site. These providers may set their own cookies and collect information directly from your browser, subject to their own privacy policies.

Your choices. Most browsers let you refuse or delete cookies through their settings. You can opt out of Google Analytics at tools.google.com/dlpage/gaoptout, manage Google ad personalization at adssettings.google.com, and manage Meta ad preferences in your Facebook or Instagram account settings. Industry opt-out tools are available at optout.aboutads.info and optout.networkadvertising.org. Blocking cookies may affect how parts of the Site function.

Global Privacy Control. Where required by applicable law, we treat a Global Privacy Control (GPC) or similar browser signal as a valid request to opt out of targeted advertising and the sale or sharing of personal information for the browser transmitting the signal.

Do Not Track. Because there is no common industry standard for interpreting "Do Not Track" browser settings, the Site does not currently respond to them other than as described above for GPC.

How We Communicate With You

When you submit our contact form or otherwise reach out, you are asking us to respond. We will contact you by email and by telephone using the information you provide, in order to answer your inquiry, schedule a consultation, and discuss your project.

If you become a client, we will communicate with you by email and phone throughout the project about scheduling, selections, change orders, invoicing, inspections, and completion.

We may also send occasional marketing emails about our completed projects, services, and news. You may opt out of marketing emails at any time by using the unsubscribe link in any marketing message or by emailing austin@theorugroup.com. We may continue to send you non-marketing messages relating to an inquiry you submitted, an active project, or our legal obligations. If you would prefer that we not call you, tell us and we will note that preference.

We do not currently send marketing text messages. If we begin doing so, we will obtain the consent required by applicable law and provide clear opt-out instructions.

Your Privacy Rights

Rights Available to All Visitors

Regardless of where you live, you may contact us at austin@theorugroup.com to ask what personal information we hold about you, request a correction, request deletion, or unsubscribe from marketing communications. We will respond to reasonable requests as described in Section 9.5.

Texas Residents

Under the Texas Data Privacy and Security Act, Texas residents have the right to: confirm whether we process their personal data and access that data; correct inaccuracies; delete personal data provided by or obtained about them; obtain a portable copy of data they provided to us; and opt out of the processing of personal data for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects.

Notice required by Texas law: We may sell or share your sensitive personal data only with your consent, and we do not knowingly do so. To the extent our sharing of personal data with advertising partners constitutes a "sale" under Texas law, you may opt out using the methods in Section 9.6.

California Residents

Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, California residents have the right to know the categories and specific pieces of personal information we have collected, the sources of that information, our purposes for collecting it, and the categories of third parties to whom we disclose it; to request deletion; to request correction; to opt out of the sale or sharing of personal information for cross-context behavioral advertising; to limit the use of sensitive personal information; and to be free from unlawful discrimination for exercising these rights.

In the preceding twelve months, we have collected the categories of personal information described in Section 3 (identifiers, internet and network activity, approximate geolocation, professional or employment-related information, commercial information, visual information in the form of project photographs, and inferences drawn from the foregoing), for the purposes described in Section 4, and disclosed those categories to the recipients described in Section 5. We have shared identifiers and internet or network activity information with advertising partners for cross-context behavioral advertising. We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.

You may designate an authorized agent to submit a request on your behalf. We may require the agent to provide proof of authorization and may require you to verify your identity directly with us.

Other U.S. State Residents

Residents of states including Colorado, Connecticut, Virginia, Utah, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, and Rhode Island may have rights of access, correction, deletion, portability, and opt-out of targeted advertising, sale, and certain profiling, subject to the terms of their state's law. Where a state law provides an appeal process, you may appeal our decision on a rights request by replying to our response or emailing austin@theorugroup.com with the subject line "Privacy Appeal." We will inform you in writing of the outcome and, where applicable, how to contact your state attorney general.

How We Handle Requests

To submit a request, email austin@theorugroup.com with the subject line "Privacy Request" and tell us which right you are exercising and the state or country in which you reside. We will take reasonable steps to verify your identity, which may include asking you to confirm information already in our records or to respond from an email address associated with your inquiry or project. We respond within the timeframe required by applicable law, generally within 45 days, and may extend that period where permitted by providing you notice. We do not charge a fee for a first request in a twelve-month period unless the request is manifestly unfounded, excessive, or repetitive. We will not discriminate against you for exercising your rights.

Please note that we may be unable to delete certain information that we are required to retain for legal, tax, insurance, warranty, lien, or construction recordkeeping purposes, or that is necessary to complete an active project.

Opting Out of Targeted Advertising and Sale or Sharing

You may opt out by: (a) emailing austin@theorugroup.com with the subject line "Opt Out of Sale/Sharing"; (b) enabling Global Privacy Control in a supported browser; or (c) using the platform-level and industry opt-out tools listed in Section 7.

European Economic Area, United Kingdom, and Switzerland

If the GDPR or UK GDPR applies to you, you have the rights of access, rectification, erasure, restriction of processing, data portability, and objection to processing based on legitimate interests or carried out for direct marketing, as well as the right to withdraw consent at any time without affecting the lawfulness of prior processing. You also have the right to lodge a complaint with your local supervisory authority.

Nevada residents may direct us not to sell certain covered information by emailing austin@theorugroup.com with the subject line "Nevada Opt-Out."

International Transfers

Growth Building Solutions LLC is based in Texas, and our service providers are located primarily in the United States. If you access the Site or provide information from outside the United States, your information will be transferred to, stored in, and processed in the United States, where privacy laws may differ from those in your country. Where required, we rely on appropriate safeguards for such transfers, including the European Commission's Standard Contractual Clauses.

Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy.

Because we work in construction and development, some records must be kept substantially longer than a typical website inquiry. Project records — including contracts, plans, specifications, change orders, permits, inspection records, invoices, warranty documentation, and project correspondence — are retained for the period necessary to satisfy our legal, tax, insurance, warranty, and lien obligations and to defend against claims, which under Texas law may extend for years after substantial completion. Inquiry and marketing records are retained while they remain useful to our business and while you remain subscribed, and for a reasonable period afterward for suppression and compliance purposes. Website analytics data is retained according to the settings of our analytics providers. When information is no longer needed, we delete it or de-identify it.

Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction, including encryption of data in transit, access controls, and vendor due diligence. No method of transmission over the internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security.

A note on wire fraud. Criminals target construction and real estate transactions by impersonating builders, title companies, and lenders in order to redirect payments. We will never send you changed wire or payment instructions by email without independent verification. If you receive payment instructions that appear to come from us, call a known number for our team and verbally confirm them before sending funds. Report anything suspicious to austin@theorugroup.com immediately.

Children's Privacy

The Site and Services are intended for adults and are not directed to children. We do not knowingly collect personal information from anyone under 18 years of age. If we learn that we have collected personal information from a child under 13, or from a minor in circumstances requiring parental consent under applicable law, we will delete it promptly. A parent or guardian who believes a child has provided us with personal information may contact us at austin@theorugroup.com.

Third-Party Websites and Platforms

The Site contains links to and embeds content from third-party websites, social media platforms, and video hosts. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policy of any third-party site or service you visit or use.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. When we do, we will revise the "Last Updated" date at the top of this page. If we make material changes, we will provide additional notice, such as by posting a prominent notice on the Site. Your continued use of the Site after the effective date of a revised Privacy Policy constitutes your acknowledgment of the changes.
